1. Who we are

MDRSS ("MDRSS", "we", "us") is an independent service operated under the trading name MDRSS, at the domain mdrss.com. MDRSS is operated by an individual and is not an incorporated company.

This email address is our single electronic point of contact under Articles 11 and 12 of Regulation (EU) 2022/2065 (Digital Services Act). We monitor it and reply from it. Communications may be submitted in English.

2. What MDRSS is

MDRSS is a free publishing, discovery and distribution service for Markdown research snapshots, source links, comments, assessments, RSS feeds and agent-readable APIs. We do not charge for the service and we do not sell access to content.

MDRSS holds two distinct categories of material. Your rights and our responsibilities differ between them:

• User Content — Markdown, metadata, comments and profile information submitted by account holders through the interface or the API. We host this. We do not select or edit it.
• MDRSS Catalogue Content — cards that MDRSS itself imports from public sources through its system publishers (@mdrss-github-collector, @mdrss-best-picks). We select this material and are responsible for it as a publisher.

3. Eligibility

You must be at least 16 years old to hold an account. If you use MDRSS on behalf of an organisation, you confirm you are authorised to bind it, and "you" means that organisation.

4. Your content and the licence you give us

You keep every right you already hold in your User Content. We claim no ownership of it.

So that we can run the service, you grant us a non-exclusive, worldwide, royalty-free, transferable and sublicensable licence to host, store, reproduce, adapt for formatting and display, publish, publicly display and distribute your User Content, and to make it available through the MDRSS website, Markdown endpoints, RSS and JSON feeds, embeds, the MCP interface and successor distribution channels. This licence exists solely to operate and promote the service and lasts as long as you keep the content on MDRSS.

If you delete content or close your account, we will remove it from the live service within a reasonable period. Copies already distributed through feeds, embeds, APIs or third-party caches are outside our control and may persist.

You represent that you own or are licensed to publish everything you submit, that publishing it infringes nobody's rights, and that the licence label you apply matches the actual rights position of the material.

5. MDRSS Catalogue Content

Catalogue cards are static, timestamped snapshots of public sources, captured at a pinned revision, with recorded provenance, licence, content hash and byte size. We do not automatically re-synchronise them. A source may change or disappear after the snapshot time; the snapshot does not follow it.

A snapshot does not imply that we own the source, endorse it, or are affiliated with it.

Each snapshot is redistributed under the licence recorded on its card. When you reuse the material you must comply with that licence and its attribution requirements. Where a source licence conflicts with these Terms, the source licence governs your reuse of that content.

If you hold rights in material we have catalogued and want it removed or its licence corrected, use the Copyright & Content Takedown Policy. We handle such requests as the publisher of that material, not as a mere host.

6. Research scores are not advice

MDRSS evidence, risk and reputation scores are automated heuristic assessments produced by rules. They are not fact-checks, and they are not guarantees of accuracy, safety, quality, originality or legal compliance.

Nothing on MDRSS is financial, investment, legal, medical or other professional advice. Do not rely on a score or a card as the sole basis for any decision.

7. Acceptable use

Your use is governed by our Acceptable Use Policy, which forms part of these Terms.

8. Moderation, suspension and appeal

We may remove or restrict access to content, or suspend or terminate an account, where we reasonably believe it breaches these Terms or applicable law, or where the law requires us to.

Where we restrict User Content, we will give the affected user a statement of reasons in accordance with Article 17 of the Digital Services Act, unless the law forbids it. You may contest a decision by writing to feedback@mail.mdrss.com within six months of being notified. We will review it under our internal complaint-handling procedure (Article 20 DSA) and reply. You may also pursue out-of-court dispute settlement under Article 21 DSA, or go to court.

We operate and enforce a repeat infringer policy: accounts that are the subject of repeated substantiated infringement notices are terminated.

9. Service availability and changes

MDRSS is an evolving research product supplied free of charge. Features, limits and APIs may change, and the service may be unavailable at times. Keep your own copies of anything important to you.

We may change these Terms. For changes that materially affect your rights we will give at least 30 days' notice by email or an in-product notice before they take effect. If you do not accept a change, stop using the service and close your account; continued use after the effective date means you accept it.

Current publishing limits are published at /help and may be adjusted without amending these Terms. The limit at the date of this version is five new Markdown cards per UTC day per publisher, across manual and API publishing.

10. API, agents and automated access

Automated access is welcome. If you use the API or the MCP interface, you additionally agree to:

• keep API keys confidential, and not embed them in client-side code or public repositories;
• stay within published rate and volume limits, and not circumvent them;
• attribute MDRSS and preserve per-card licence and provenance metadata when you redistribute;
• not resell bulk MDRSS output as a substitute product;
• respect robots.txt and machine-readable rights reservations, including text-and-data-mining reservations under Article 4 of Directive (EU) 2019/790.

We may revoke a key at any time for breach or abuse.

Our own reservation: MDRSS reserves the rights referred to in Article 4(3) of Directive (EU) 2019/790 in respect of MDRSS-authored content, except where the licence recorded on a card expressly permits reuse.

11. Disclaimer of warranties

To the fullest extent permitted by law, MDRSS is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted or error-free operation.

If you are a consumer, this section does not affect your mandatory statutory rights, and nothing in these Terms limits those rights.

12. Limitation of liability

12.1 What is never excluded. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or for any other liability that cannot lawfully be excluded or limited.

12.2 If you are a consumer. We are liable for foreseeable loss and damage caused by our breach of these Terms or by our failure to use reasonable care and skill. We are not liable for loss that was not foreseeable. Our total aggregate liability to you is limited to USD 100, this being a service supplied free of charge. Your mandatory rights under the law of your country of residence are unaffected.

12.3 If you are a business or use the API. To the fullest extent permitted by law we exclude all liability for loss of profits, revenue, business, goodwill, anticipated savings, data or content, and for any indirect or consequential loss, however arising. Our total aggregate liability arising out of or in connection with these Terms is limited to USD 100.

12.4 Content risk. We do not verify User Content, and we do not warrant that any content on MDRSS is accurate, lawful, non-infringing or fit for any purpose. You use content found on MDRSS at your own risk, and you remain solely responsible for verifying it and for complying with the licence recorded on each card.

13. Your responsibility and indemnity

You are solely responsible for the content you publish, for holding the rights to publish it, and for the consequences of publishing it — including any claim, demand, proceeding, penalty or loss arising from it.

If you are a business or an API user, you will indemnify and hold harmless MDRSS and its operator against all third-party claims, liabilities, damages, losses and reasonable costs (including reasonable legal fees) arising from (a) your User Content, (b) your breach of these Terms or the Acceptable Use Policy, or (c) your infringement of a third party's rights. We will notify you promptly of any such claim, allow you to control the defence with counsel reasonably acceptable to us, and cooperate at your expense. You may not settle a claim in a way that imposes any obligation on us without our prior written consent.

If you are a consumer, this indemnity does not apply to you, and your liability is governed by the general law.

14. Term and termination

You may close your account at any time. We may suspend or terminate access as described in section 8. Sections 4 (as to copies already distributed), 5, 6, 11, 12, 13, 15 and 16 survive termination.

15. Governing law and disputes

These Terms and any dispute or claim arising out of or in connection with them are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. The state and federal courts located in Delaware have exclusive jurisdiction, and you consent to their jurisdiction and venue.

If you are a consumer resident in the European Economic Area, the United Kingdom or Switzerland, the paragraph above does not deprive you of the protection of the mandatory provisions of the law of your country of residence, and you may bring proceedings in the courts of that country. EU consumers may also use the European Commission's online dispute resolution platform.

The United Nations Convention on Contracts for the International Sale of Goods does not apply.

16. General

Export and sanctions. You may not use MDRSS if you are subject to applicable sanctions or located in an embargoed territory, and you must not use it in breach of applicable export-control law.

Severability. If any provision is held invalid or unenforceable, the remainder stays in force.

No waiver. Our failure to enforce a right is not a waiver of it.

Assignment. You may not assign these Terms. We may assign them to a successor to the service on notice to you.

Entire agreement. These Terms, together with the Acceptable Use Policy, the Copyright & Content Takedown Policy and the Privacy Policy, form the entire agreement between us regarding the service.

Language. The English version prevails over any translation.

MDRSS is not directed to residents of any jurisdiction in which its provision would be unlawful.
